Terms of Service for IndiaConsent

These Terms of Service (“Terms”) govern your access to and use of the IndiaConsent platform (“Platform”) operated by Jobihood Technologies Pvt Ltd (“Company”, “we”, “us”, “our”), a company incorporated in India with its registered office at B-46, Ground Floor, Gujranwala Town-1, Delhi-110009.
By accessing or using the Platform, you agree to these Terms. If you do not agree, you must not use the Platform. These Terms should be read together with our Privacy Policy and Cookie Policy.
1. Our Role as Consent Manager
IndiaConsent operates (or is preparing to operate) as a Consent Manager under the Digital Personal Data Protection Act, 2023 and the DPDP Rules, 2025.
We act solely as a neutral, data-blind intermediary and owe direct fiduciary duties to Data Principals. We do not read, access, store, or process the underlying personal data shared between Data Principals and Data Fiduciaries. All such personal data is routed through the Platform in an encrypted, unreadable manner to us, as required under First Schedule, Part B, item 2.
Data Fiduciaries remain fully responsible for the lawfulness of their processing, including the provision of clear notices and obtaining valid consent.
2. Service Description
The Platform enables Data Principals to give, manage, review, and withdraw consent, and facilitates data portability where applicable. It also allows Data Fiduciaries to send consent requests through a single, interoperable interface.
We maintain tamper-evident, cryptographically verifiable records of consents, notices, and sharing events, which are available to Data Principals upon request in machine-readable format (as detailed in our Privacy Policy).
3. Eligibility
You must be at least 18 years of age (or the age of majority under applicable law) to use the Platform. The Platform is not intended for children below 18 years. If you are a Data Fiduciary, you represent that you are duly incorporated/registered and authorised to use the Platform.
4. Account Responsibilities
- You must provide accurate, complete, and up-to-date information.
- You are responsible for maintaining the confidentiality of your account credentials.
- Data Principals must review consent requests carefully before granting consent.
- Data Fiduciaries must ensure all consent requests and notices comply with the DPDP Act and Rules.
5. User Responsibilities
Data Principals shall:
- Use the Platform only for lawful consent management.
Data Fiduciaries shall:
- Provide accurate purpose, data categories, and other required details in consent requests.
- Ensure all processing of personal data is lawful and compliant with the DPDP Act.
- Not hold us responsible for their own compliance obligations.
6. Platform Limitations and Disclaimers
The Platform is provided on an “as is” and “as available” basis.
We do not:
- Verify the legality, accuracy, or completeness of consent requests or notices sent by Data Fiduciaries.
- Control or validate the underlying personal data or how Data Fiduciaries process it.
- Guarantee uninterrupted or error-free service.
Nothing in these Terms limits or excludes our statutory obligations or liability under the DPDP Act and Rules as a Consent Manager, including our duties to maintain tamper-evident records, implement reasonable security safeguards, and act in the interest of Data Principals.
7. Prohibited Use
You shall not:
- Use the Platform for any unlawful, fraudulent, or harmful purpose.
- Attempt to gain unauthorised access, interfere with, or disrupt the Platform.
- Misrepresent your identity or any company details.
- Misuse the consent mechanisms or attempt to tamper with audit logs.
- Engage in any activity that violates these Terms or applicable law.
8. Suspension and Termination
We may suspend or terminate your access to the Platform, with or without notice, if:
- You breach these Terms.
- We reasonably believe it is necessary for security, legal compliance, or to protect Data Principals.
- Required by the Data Protection Board of India or other authorities.
9. Indemnity
You agree to indemnify, defend, and hold harmless the Company, its directors, officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or in connection with:
- Your use of the Platform (except to the extent caused by our breach of statutory duties as Consent Manager).
- Your violation of these Terms or applicable law.
- Any content or data you provide through the Platform.
This indemnity does not apply to claims directly resulting from our gross negligence or wilful misconduct.
10. Limitation of Liability
To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
Our total liability to you shall not exceed the fees paid by you to us in the twelve (12) months preceding the claim (if any).
The above limitations do not apply to liability that cannot be excluded under the DPDP Act, including for breach of our obligations as a Consent Manager.
11. Force Majeure
We shall not be liable for any failure or delay in performance due to events beyond our reasonable control, including acts of God, government actions, pandemics, or internet disruptions.

We will acknowledge and endeavour to resolve grievances as per timelines under the DPDP Rules. Details are also provided in our Privacy Policy.
13. Modifications
We may update these Terms from time to time to reflect regulatory changes or improvements. Material changes will be notified on the Platform. Your continued use after the effective date of the updated Terms constitutes acceptance. We encourage you to review the Terms periodically.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Delhi.
